End User License Agreement
This End User License Agreement ("Agreement") is a legal agreement between you ("User," "you," or "your") and JetCard Virtual Systems LLC ("JetCard," "we," "us," or "our") governing your use of the JetCard desktop application, associated services, and website (collectively, the "Platform").
By clicking "I Accept" or using the Platform, you agree to be bound by this Agreement. If you do not agree, do not use the Platform.
1.1. JetCard is a flight simulator companion application designed for entertainment and educational purposes. It interfaces with third-party flight simulation software including Microsoft Flight Simulator and X-Plane.
1.2. JetCard is NOT a real-world aviation product. Nothing in the Platform constitutes flight training, aviation advice, or operational guidance. The Platform shall never be used for real-world flight planning, navigation, or aviation decision-making.
1.3. All airlines, charter operators, clients, financial institutions, brokers, and other entities depicted within the Platform are entirely fictional. Any resemblance to real organizations is coincidental, except where real-world flight simulation add-ons or airports are referenced for compatibility purposes.
2.1. We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Platform on a single computer for personal, non-commercial use.
2.2. Your license is activated by a unique license key ("License Key") issued upon purchase. Each License Key is valid for one user and may not be shared, resold, or transferred.
2.3. We reserve the right to limit simultaneous active sessions per License Key.
3.1. You must create an account to use the Platform. You are responsible for maintaining the confidentiality of your login credentials.
3.2. We collect and store the following data in connection with your use of the Platform:
- (a) Account information: email address, display name, home base airport
- (b) Flight data: charter history, financial transactions, reputation scores, aircraft fleet records, operator membership
- (c) Simulator telemetry: aircraft position, altitude, speed, heading, and flight phase data transmitted during active flights
- (d) Integration tokens: Navigraph and SimBrief authentication tokens for flight planning services
3.3. Flight telemetry data transmitted during active flights may be visible to other users via the Live Map feature. By using the Platform, you consent to this visibility during active flight sessions.
3.4. Your data is stored on servers provided by Supabase, Inc. We implement reasonable security measures but cannot guarantee absolute security of your data.
3.5. We do not sell your personal data to third parties. Data may be shared with service providers (Supabase, Stripe, Vercel) solely for Platform operation.
4.1. The Platform features a virtual economy including virtual currency, virtual aircraft, virtual loans, and virtual business operations. These have NO real-world monetary value.
4.2. Virtual balances, assets, reputation scores, and other in-game values exist solely within the Platform and cannot be exchanged for real currency, goods, or services.
4.3. We reserve the right to modify, reset, or adjust any aspect of the virtual economy at any time for balancing, bug fixes, or feature development purposes.
5.1. License Key purchases are processed by Stripe, Inc. By making a purchase, you also agree to Stripe's terms of service.
5.2. License Keys are digital goods. Refund requests are handled on a case-by-case basis. Contact support@flyjetcard.io for refund inquiries.
5.3. Promotional pricing, discount codes, and free access periods may be offered at our sole discretion and may expire or be revoked at any time.
6.1. The Platform may be designated as "Alpha," "Beta," or "Early Access." During these periods, the Platform is provided on an as-is basis with known and unknown bugs, incomplete features, and potential data resets.
6.2. We may issue time-limited License Keys during beta periods. These keys will expire on the date specified at issuance.
6.3. We reserve the right to wipe, reset, or modify user data during alpha and beta periods without prior notice.
7.1. The Platform integrates with third-party services including but not limited to Microsoft Flight Simulator (SimConnect), X-Plane, Navigraph, SimBrief, and ElevenLabs. These services are governed by their own terms and we are not responsible for their availability or functionality.
7.2. We are not affiliated with, endorsed by, or sponsored by Microsoft, Laminar Research, Navigraph, or any flight simulation add-on developer unless explicitly stated.
8.1. You agree not to:
- (a) Reverse engineer, decompile, or disassemble the Platform
- (b) Modify, adapt, or create derivative works of the Platform
- (c) Use the Platform to harass, abuse, or harm other users
- (d) Exploit bugs, glitches, or unintended features for competitive advantage without reporting them
- (e) Attempt to manipulate the virtual economy through automated means
- (f) Share, sell, or distribute your License Key
- (g) Circumvent any access controls or usage limitations
8.2. We reserve the right to suspend or terminate your account for violations of this Agreement.
9.1. The Platform, including its code, design, artwork, audio files, data structures, and documentation, is the property of JetCard Virtual Systems LLC and is protected by copyright and other intellectual property laws.
9.2. User-created content within the Platform (operator names, callsigns, etc.) is subject to moderation and may be removed if deemed inappropriate.
10.1. THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10.2. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
10.3. WE MAKE NO GUARANTEES REGARDING UPTIME, DATA PERSISTENCE, OR FEATURE AVAILABILITY.
11.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, JETCARD VIRTUAL SYSTEMS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.
11.2. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR LICENSE KEY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12.1. We may update this Agreement from time to time. Material changes will be communicated through the Platform. Continued use after changes constitutes acceptance.
12.2. We reserve the right to modify, update, or discontinue any feature of the Platform at any time.
13.1. You may stop using the Platform at any time. We may terminate or suspend your access for violation of this Agreement or at our discretion.
13.2. Upon termination, your license to use the Platform ceases. We are not obligated to maintain your data after termination.
14.1. This Agreement is governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with applicable rules.
